Apple To Pay Sh1.3 Billion Fine for Misleading iPhone Water Resistant Claims


The authority criticised Apple for not clarifying that the property is found only under specific conditions like during controlled and specific laboratory tests using pure and static water, and not under normal conditions in which its devices are used by consumers.

Criticising Apple for not clarifying its water resistance claims, the AGCM said the claims were true only under certain circumstances. "The guarantee does not cover damage caused by liquids" is a disclaimer Apple offers up - something that goes against the advertising Apple uses to promote iPhone and its water resistance. The current iPhone 12, iPhone 12 mini, iPhone 12 Pro and iPhone 12 Pro Max have a rating of IP68. It is said that Apple failed to fix iPhones under warranty that had been damaged by water. The regulator claimed that this constituted an "aggressive" commercial practice by essentially marketing a feature that the company is unwilling to actually stand behind. Apple however provides a list of suggestions on what to do if their phone gets wet - even if something spills on it - and how to mitigate any possible damage.
